Anti-abortion law in USA’s Idaho faces lawsuit

SW News: An anti-abortion law in the American state of Idaho is facing a lawsuit filed by two advocacy groups and an attorney. The law in question is the one that makes it illicit to help minors undergo an abortion without parental consent.

This law also prevents minors from seeking abortion in other states where it is permitted. Any violation is treated as a felony and it can be punished with a minimum of two years and a maximum of five years in jail.

It was on Tuesday that the Legal Voice activist group filed a lawsuit in the federal court on behalf of Nampa attorney Lourdes Matsumoto, the Northwest Abortion Access Fund and the Indigenous Idaho Alliance. They filed the lawsuit as they are engaged in assisting minors get an abortion. The plaintiffs argue that the new law of Idaho goes against the First Amendment guarantee to discuss the topic of abortion with minors and the Fourth Amendment right to travel without hassles between states.

In the lawsuit, the plaintiffs argue that "Ignoring that some of the minors may seek an abortion because they were sexually abused by a parent or guardian, that they have consulted with trusted adults who support their position, or that they are actual victims of human trafficking," lawmakers attempted to prevent minors seeking abortion from crossing the state border for medical care.

The office of the Attorney General of Idaho Raul Labrador has made it clear that it is always willing to defend the laws passed by the legislature. He had earlier made it clear that his office had the power to prosecute violators of the new law even if the prosecutor refused to prosecute.
